General Terms and Conditions

These general terms and conditions govern the relationship between Hostado Solutions LTD, a company registered under the Commercial Code of the Republic of Bulgaria with UIC 208502081 and a website located at the following internet address: https://en.hostado.net hereinafter referred to as “hostado”; “We/Us” on the one hand, and the Users of websites and services located on the website https://en.hostado.net (Website/s; Site/s) hereinafter referred to as “Users”; “You”, on the other.

This document contains information about hostado’s activities and the general terms and conditions for using the services provided by hostado, governing the relationship between Us and each of our users.

Any new features or tools that are added to the current website are also subject to the Terms and Conditions. You can review the most current version of the Terms and Conditions at any time on this page. We reserve the right to update, modify or replace any part of these Terms of Use by posting updates and/or changes on our website. It is your responsibility to periodically check this page for changes. Continued use or access to the website after the posting of any changes constitutes acceptance of those changes. By accepting the Terms and Conditions, the User agrees to the processing of his/her personal data on the basis of the contract concluded between him/her and the Merchant.

By agreeing to these Terms of Use, you represent that you are at least the age of majority in your state and/or province of residence, or that you are the age of majority in your state and/or province of residence and have consented to us allowing any of your minor dependents to use this site.

You may not use our products or services for any illegal or unauthorized purpose, nor may you, in using the Service, violate any laws in your jurisdiction (including, but not limited to, copyright laws).

Violation of any of the Terms will result in immediate termination of your Services.

  • Service contract– a contract, other than a sales contract, under which the trader provides or undertakes to provide a service to the consumer, and the consumer pays or undertakes to pay the price for it.
  • Procedure for alternative resolution of consumer disputes – a procedure for out-of-court resolution of consumer disputes, meeting the requirements of this law and carried out by an alternative consumer dispute resolution body.

GENERAL TERMS AND CONDITIONS

You understand that your data may be transferred unencrypted and may involve (a) transmission over various networks; and (b) modifications to conform to and adapt to the technical requirements of connecting networks or devices.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service or access to the Service or any contact on the website through which the service is provided, without express written permission from us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

CHANGES IN SERVICE AND PRICES

The prices of our products and services are subject to change without notice. We reserve the right to change or add/discontinue the Service (or any part or content thereof) at any time.

We will not be liable to you or any third party for any modification, price change, suspension or termination of the Service.

SECTION V

  1. Services provided

Users have the opportunity to enter into service, purchase, sale and delivery contracts for the services offered by hostado, namely:

  • Website development and/or maintenance
  • Application development
  • Web design
  • Search engine optimization (SEO optimization)
  • Digital Marketing
  • Others
  1. Order

Users use the website interface to submit a request to conclude contracts with the Merchant for the offered goods and services. The contract for the purchase and sale of a service is considered concluded from the moment of confirmation of the order by the Merchant.

The prices of the goods or services offered are those indicated on the Merchant’s website at the time of placing an order, except in cases of obvious error. For all services requested by a User to hostado, the User must pay 50% of the amount due in advance. In the event that a User concludes a subscription service agreement with hostado, the price that must be paid in advance is equal to twenty-five percent of the agreed amount for the period of the subscription service provided by hostado, but not less than the price equivalent to a 3 (three) month subscription plan. The prices of the goods and services include VAT, in cases where its charging is provided. The Merchant reserves the right to change the prices of the goods and services offered on the site at any time and without notice, and such changes will not affect orders already placed, except in cases of a concluded subscription service agreement.

The Merchant may provide discounts for the goods and services offered on the Site, in accordance with Bulgarian law and rules set by the Merchant. The rules applicable to such discounts are available at the location where the discount is displayed. Discounts may be provided in various forms (e.g. promotions, loyalty discounts, provided individually, randomly or as a result of participation in a competition or customer survey).

Different types of discounts cannot be combined when ordering and purchasing the same product/service.

III. Warranties and complaints

The consumer has the right to complain about any non-compliance of the goods or services with what was agreed/ordered, when, after receipt, non-compliances with the sales contract are discovered.

The merchant is not responsible for any color differences due to natural differences in color reproduction between different monitor models.

Any lack of conformity of the consumer service with the sales contract that becomes apparent within 6 months after performance is deemed to have existed at the time of its delivery, unless it is proven that the lack of conformity is due to the nature of the service or the nature of the lack of conformity.

The consumer cannot dispute the conformity of the service provided with the contract for its sale when:

  • When concluding the contract, he knew or could not have been unaware of the non-conformity;
  • The discrepancy is due to materials provided by the user.

The consumer has the right to file a complaint about the goods or service, regardless of whether the manufacturer or trader has provided a commercial guarantee for the goods or service.

  1. Create an account

1.1 Conditions that the User must meet to create an Account

The User who has an Account and uses the Services must be a representative of the Service User or a representative of the Project Owner. Accounts created by “bots” or other automated methods are not permitted.

To create and maintain a Profile, the Service User Representative or Project Owner Representative must:

  • Be over 18 years old,
  • To have the right to represent and bind the Service User or the Project Owner in the use of the Services,
  • Provide your full legal name and a valid email address,
  • Have not been prohibited by hostado from creating an Account or using the Services,
  • Not to infringe the rights of the Company, including intellectual property rights, such as copyrights, trademarks and patents.
    2. Other information that must be provided by the User as part of the process of performing the requested service

As part of the Service User profile creation process and in order to build a basic Service User profile that will be seen by other users, the Service User agrees to provide basic information, including:

2.1 Name and address;

2.2 Telephone number;

2.3 Contact email address;

2.4 Website address;

2.5 The type of services provided, area of ​​expertise and minimum budget;

2.6 Brief description of the services provided;

2.7 Access to available business accounts on social networks for the purpose of performing the desired service.

  1. hostado’s right regarding account creation

hostado reserves the right, at its sole discretion, to accept or reject the creation of any account.

  1. Project Description Form

To describe their project, the project owner agrees to complete the project description form with basic information (not an exhaustive list), including information such as:

4.1 The name of the person and/or company;

4.2 Scope of activity;

4.3 Brief description of the project;

4.4 The necessary services;

4.5 The position of the project owner’s representative in the company;

4.6 The estimated budget for the project;

4.7 The location of the searched User;

4.8 The languages ​​for production, translation and/or other requested by the User when submitting a request for performance and/or subscription service.

  1. The profile of the Service User and the project owner

5.1 To make the User’s profile more attractive, the Service User may complete their profile with additional information, such as:

5.1.1 Description and history of the Service User;

5.1.2 Previous achievements;

5.1.3 Location of the office(s);

5.1.4 Services and competencies offered;

5.1.5 Logo, cover image, team photo and slogan;

5.1.6 Links to social networks, customer reviews, awards, certificates, etc.

  1. Change of basic and additional information

6.1 Users acknowledge that the required basic information specified in Section V, items 2 to 5 is subject to change and agree to provide any other information that the Company may deem necessary to perform the service and to describe the Project.

6.2 Users acknowledge that the Additional Information specified in Section V, item 5 is subject to change. hostado may at any time give Users the opportunity to voluntarily send any other type of additional information necessary to perform the requested service.

  1. Obligations regarding the provision of information

7.1 The Basic and Additional Information, as well as any other information provided by Users or Project Owners when using the Site, must be:

7.1.1 True, accurate, current and complete.

7.1.2 Timely updated to remain true, accurate, current and complete.

7.2 When providing the Basic and Additional Information, as well as any other information when using the Services, Users and Project Owners are prohibited from engaging in any activity or directing anyone to engage in any activity that is contrary to applicable laws and/or regulations, including, but not limited to, criminal laws, commercial laws, privacy laws, intellectual property laws, anti-spam laws.

7.3 Users are strictly prohibited from submitting, publishing, displaying, sharing, uploading, downloading or exchanging:

7.3.1 Information that is offensive, harmful, defamatory, threatening, harassing, pornographic, obscene, racist or otherwise aimed at denigrating and stigmatizing groups of people;

7.3.2 Information that undermines collective memory, such as revisionism or denial;

7.3.3 Information intended to organize a criminal project, including, but not limited to, trafficking in human beings, prohibited substances or weapons;

7.3.4 Information that infringes the intellectual property rights of the Company, Users or third parties;

7.3.5 Information that cannot be disclosed, such as confidential information or information belonging to Users or third parties that cannot be disclosed without their express consent;

7.3.6 Unsolicited advertising, “junk mail”, “spam”, “chain letters”, “pyramid schemes”, phishing or any other form of solicitation not permitted by hostado;

7.3.7 Information that contains malware, viruses, worms or other harmful code or computer programs.

The obligations regarding the provision of information set out in Section V also apply to any other User who sends, publishes, displays, uploads, downloads or exchanges information on the Website or the Platform.

  1. Public display of information on the Website and Platform

Users and/or Project Owners acknowledge and agree that the Basic and Additional Information may be publicly available on the Website.

  1. No obligation to monitor and no control over user behavior or information

9.1 The Company has no obligation to monitor, review the information provided by the User when using the Services, nor does it have an obligation to actively seek facts or circumstances indicating the illegal or unlawful nature of this information.

9.2 The Company has no control over the User’s conduct and the information provided by the User when using the Services. However, hostado reserves the right, at its sole discretion, to subsequently verify such information.

SECTION VI
ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order/request you place with us. We may, at our sole discretion, limit or cancel the quantities of orders purchased and/or requested for any individual and/or entity, and/or household. These limits may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time of ordering. We reserve the right to limit or prohibit orders that, in our sole discretion, appear to be placed by dealers, resellers, or distributors.

Termination and cancellation of the contract

hostado has the right, at its discretion, without prior notice, to unilaterally terminate the contract if it finds that the services provided are used in violation of these general terms and conditions, the legislation of the Republic of Bulgaria and generally accepted moral standards.

Except in the cases provided for in these General Terms and Conditions, the contract between the parties shall also be terminated upon cessation of the Merchant’s activities or termination of the maintenance of its website.

Outside the cases specified above, either party may terminate this contract after the expiration of the initial 6 (six) months of its validity, by giving one month’s notice to the other party in case of non-fulfillment of the obligations under the contract.

Section XIII
COMPENSATION

You agree to indemnify, defend and hold harmless hostado and our subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION XIV
DIVIDABILITY

In the event that any provision of these Terms of Use is determined to be unlawful, invalid or unenforceable, such provision shall nevertheless be enforceable to the maximum extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms of Use, such determination not affecting the validity and enforceability of any remaining provisions.

FINAL PROVISIONS

The obligations of the parties incurred prior to the date of termination shall survive the termination of this Agreement for all purposes.

These Terms of Use are effective unless and until terminated by you or us. You may terminate these Terms of Use at any time by notifying us that you no longer wish to use our Services.

If in our sole discretion you fail or we suspect that you have failed to comply with any term or provision of these Terms of Use, we may also terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or may accordingly deny you access to our Services (or any portion thereof).

THE ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision.
